FruTech™ Terms & Conditions

These Terms & Conditions ("Terms") apply to your access and use of the Frutech™ services, website, and any other Frutech™ branded properties (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Use of the Services

  • You may only use the Services for lawful purposes and in accordance with these Terms.

  • You agree not to use the Services:

    • In a way that violates any applicable law or regulation.

    • For any purpose that is prohibited by these Terms.

    • To infringe on the rights of others, including intellectual property rights.

    • To transmit any material that is unlawful, harmful, threatening, abusive, defamatory, invasive of privacy, or otherwise objectionable.

    • To interfere with or disrupt the Services.

2. User Content

  • The Services may allow you to submit content ("User Content").

  • You retain all ownership rights in your User Content. However, by submitting User Content, you grant Frutech™ a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and translate your User Content for the purpose of operating and providing the Services.

  • You are responsible for all User Content that you submit. You represent and warrant that you have all necessary rights to submit such User Content and that the User Content does not violate any applicable law or regulation.

3. Intellectual Property

  • The Services and all content included therein, including but not limited to text, graphics, logos, images, and software, are the property of Frutech™ or its licensors and are protected by copyright, trademark, and other intellectual property laws.

  • You agree not to remove, alter, or obscure any copyright notices or other proprietary notices placed on or contained within the Services.

4. Disclaimers

  • THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FRUTECH™ DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

  • Disclaimer of Warranties for Live Plants: Frutech™ warrants that live apple trees will arrive healthy upon delivery. However, due to the nature of live plants, Frutech™ cannot guarantee the future health or productivity of the trees.

5. Limitation of Liability

  • FRUTECH™ SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF FRUTECH™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Termination

  • Frutech™ may terminate your access to the Services at any time, for any reason, or no reason.

7. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of India.

8. Entire Agreement

  • These Terms constitute the entire agreement between you and Frutech™ regarding your use of the Services.

9. Changes to these Terms

  • Frutech™ may revise these Terms at any time by posting the revised Terms on the Services. You are responsible for checking these Terms periodically for any changes. By continuing to access or use the Services after this Terms have been revised, you agree to be bound by the revised Terms.

10. Online Transactions

  • If you make a purchase on the Frutech™ website, you agree to be bound by our online transaction terms, which will be presented to you during the checkout process. These terms will include information about payment methods, shipping, refunds, and cancellations.

11. Dispute Resolution

  • In the event of a dispute arising out of or relating to these Terms or your use of the Services, you and Frutech™ agree to attempt to resolve the dispute through informal negotiations. If the dispute cannot be resolved through informal negotiations, you and Frutech™ agree to submit the dispute to binding arbitration in accordance with the rules of a reputable arbitration organization. The arbitration shall be conducted in Srinagar Kashmir.
